# Legal profession legislation taxation information form (Costs Court)

> Link to the Costs Court form for a review of costs that is not a party-party taxation. The lawyer-client page calls the same form the lawyer-client taxation information form.

## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Costs, billing & litigation funding](https://ailawframework.com/precedents/costs-billing-and-litigation-funding.md)
- Jurisdictions: Victoria
- AI level: Red. You write the text. The tool writes nothing into the document. Where permitted, it may check, clarify or collect data, and anything it checks or collects is verified.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the official form at supremecourt.vic.gov.au and the 4 authorities it cites, for Victoria.

## When to use it

Use this when a client and a lawyer are in dispute about a bill and the matter is to go to the Costs Court, or for another review of that kind. Submit it before the summons for taxation. It is not the party-party information form.

## Used for these tasks

- [Record the 12-month date for a costs assessment application](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md#A42-PE20261022-12)
- [Answer a request for an itemised bill within the statutory time](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md#A42-PE20261022-8)
- [Build a draft bill from the time records and the disclosure](https://ailawframework.com/obligations/costs-billing-and-litigation-funding/build-a-draft-bill-from-the-time-records-and-the-disclosure.md)

## How AI may be used

The tool indexes the retainer and bill fields and does not sign the form, choose the Act, or draft an extension affidavit.

**AI may:**

- Index the retainer date, the bill dates and the amounts charged from the bills already on the file.
- List the instruction-date bands on the lawyer-client page so the lawyer can see which Act that page names.

**AI must not:**

- Do not sign the form or enter the amount charged.
- Do not decide which Act applies, and do not reconcile the Costs Court dollar figures with the Legal Services Board figures.
- Do not draft the affidavit for an application to a Judge to extend the time to issue a summons for taxation.
- Do not write a request for an itemised bill.

**The lawyer checks:**

- The form page says this form is for all reviews of costs that are not party taxations, and that it is emailed to the Costs Court and filed with the documents in the current Costs Court practice note. The page does not print an email address.
- The lawyer-client page says the summons and this form can be issued by either party, and the summons is listed for directions from the information on this form.
- If the lawyer was first instructed after 1 July 2015, that page applies Part 4.3 of the Legal Profession Uniform Law. Between 12 December 2005 and 30 June 2015 it applies the Legal Profession Act 2004. Before 12 December 2005 it applies the Legal Practice Act 1996.
- The same page states a 15 per cent reduction test where instructions were on or after 12 December 2005, and a one-sixth test where instructions were before that date. Read the costs-of-the-proceeding paragraphs before anyone is told who pays the costs of the taxation.
- The Legal Services Board disputing-your-bill page states different complaint dollar bands and different complaint times. Do not treat those as the Costs Court limit.
- A request for an itemised bill, the 30-day and 21-day periods, and the 12-month review periods are on the lawyer-client page, not on this form. An out-of-time application is made to a Judge and must be accompanied by an affidavit. The tool writes no affidavit.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
