- Practice area: [Costs, billing & litigation funding](https://ailawframework.com/precedents/costs-billing-and-litigation-funding.md)
- Jurisdictions: Victoria

- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the official form at supremecourt.vic.gov.au and the 3 authorities it cites, for Victoria.

## When to use it

Use this when a party applies for a gross sum instead of taxed costs, or the Court has ordered gross-sum costs. It is filed with the gross-sum summons. It is not the party-party or lawyer-client taxation information form.

## Used for these tasks

- [Build a draft bill from the time records and the disclosure](https://ailawframework.com/obligations/costs-billing-and-litigation-funding/build-a-draft-bill-from-the-time-records-and-the-disclosure.md)

## How AI may be used

The tool indexes the gross-sum fields and does not sign the form, state the estimate, or draft the supporting affidavit.

**AI may:**

- Index the costs order, the judgment citation and the parties from the documents already on the file.
- List the filing bundle the party-party page requires, so the lawyer can see whether an affidavit is in that bundle.

**AI must not:**

- Do not sign the form or enter the estimate of professional charges, disbursements or the total.
- Do not draft the affidavit the party-party page requires when a party applies for a gross sum instead of taxed costs.
- Do not decide whether the application is opposed, unopposed, ex parte or by consent.

**The lawyer checks:**

- The form page says the completed form is emailed to the Costs Court and filed with the documents in the current Costs Court practice note. It cites the Supreme Court (General Civil Procedure) Rules 2025 and Practice Note SC GEN 11. It does not print an email address.
- Where there is already a gross-sum order, the party-party page lists the summons, a schedule of invoices, this form, and a copy of that order. A bill in taxable form is not needed.
- Where the party is applying for a gross sum instead of taxed costs, that page also requires an affidavit and a copy of the order for taxed costs. The tool writes no affidavit.
- The party-party page says a gross-sum application is listed for directions. Read Practice Note SC GEN 11 for the procedure.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
