## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Costs, billing & litigation funding](https://ailawframework.com/precedents/costs-billing-and-litigation-funding.md)
- Jurisdictions: New South Wales
- AI level: Red. You write the text. The tool writes nothing into the document. Where permitted, it may check, clarify or collect data, and anything it checks or collects is verified.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the official form at supremecourt.nsw.gov.au and the 2 authorities it cites, for New South Wales.

## When to use it

Use when a party to a NSW costs assessment of personal injury costs wants a review of the assessor's determination. The application form may be prepared for signature. The accompanying affidavit is sworn evidence and is not generated.

## Used for these tasks

- [Check a charge against the fair and reasonable costs rule](https://ailawframework.com/obligations/costs-billing-and-litigation-funding/check-a-charge-against-the-fair-and-reasonable-costs-rule.md)
- [List the matters a costs assessor may consider](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md#A42-PE20261022-26)

## How AI may be used

The tool may list the certificates and dates already on the file, and it writes nothing in the application, the grounds, or the affidavit that must accompany the application.

**AI may:**

- List each certificate of determination on the file with its number, issue date and the date it was sent
- Note whether 30 days from the certificate being sent have already passed, for the lawyer to check
- Index the certificates, the statements of reasons and the grounds document

**AI must not:**

- Must not generate, settle or sign the affidavit under the Legal Profession Uniform Law Application Regulation cl 46
- Must not write the grounds of review or the reasons for an extension of time
- Must not sign the application or lodge it
- Must not describe the Form A4 information sheet, or invent the extra prior-notice step the form mentions for the Legal Profession Act 2004

**The lawyer checks:**

- The form in use is the current file. The forms page opened on 23 October 2026 links a file named 2026_A4_Form-2.doc. That filename is not treated as a commencement date. The information sheet was not opened
- Each determination is identified as the amount of legal costs assessed, or as the costs of the assessment, and the application says whether it is ordered party and party costs or Uniform Law costs
- A copy of each certificate and the statement of reasons is attached. The grounds clearly and concisely identify the aspects that are contested
- Item 5 is the 30 days from the certificate of determination being sent to the parties. A later application attaches an explanation for the delay. This is not the 30-day period before costs-recovery proceedings
- Item 6 says the application must be accompanied by the affidavit under cl 46, deposing that a copy was sent to the review respondents, who must be all the other parties to the original assessment. The tool does not prepare that affidavit
- The form says that if the Legal Profession Act (NSW) 2004 applies, an additional requirement of prior notice is required. The form does not set that step out. The information sheet was not opened
- The review lodgment fee on the forms page is $275. The page says a review panel is two assessors, each at $355 an hour, with a guide of $5,000 to $10,000 that may be higher. It says the review applicant is liable for the panel's cost if the panel affirms the determination, or sets it aside and varies the total costs payable by less than 15%
- Health and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).
