- Status: Maintained. Checked on 2026-10-23 against the official form at supremecourt.nsw.gov.au and the 2 authorities it cites, for New South Wales.

## When to use it

Use when a client in a NSW personal injury matter asks for an assessment of costs charged by their own law practice. Download the current form. The other party-type forms on the same index were not opened.

## Used for these tasks

- [Record the 12-month date for a costs assessment application](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md#A42-PE20261022-12)
- [Check a charge against the fair and reasonable costs rule](https://ailawframework.com/obligations/costs-billing-and-litigation-funding/check-a-charge-against-the-fair-and-reasonable-costs-rule.md)

## How AI may be used

The tool may list missing particulars from facts already on the file, and it writes nothing in the certification or the authority to inspect the file.

**AI may:**

- List which of items 1 to 13 are still blank on a draft assembled from the file
- Place the bill dates, amounts paid and the 12-month date beside item 3, for the lawyer to check
- Index the bill, costs agreement, disclosure documents and the separate objections document

**AI must not:**

- Must not write or sign section C, the certification that there is no reasonable prospect of settlement by mediation, or the authority to inspect documents
- Must not draft the separate document headed Objections, or decide the proper amount
- Must not lodge the form or calculate the lodgment fee as if the figures were settled
- Must not describe Forms A1.2, A1.3, A1.4 or A2.1 to A2.3, or any information sheet

**The lawyer checks:**

- The form in use is the current file from the costs assessment forms page. The page opened on 23 October 2026 was last updated on 6 August 2026. The information sheet was not opened
- The cover sheet box matches the work: personal injury including public liability, motor vehicle accidents, professional negligence, Dust Diseases Tribunal, or workers compensation
- Instructions before 1 July 2015 are marked for the Legal Profession Act 2004 Pt 3.2. Instructions on or after that date are marked for the Uniform Law Pt 4.3. The form says a Legal Profession Act 1987 Pt 11 application, preserved by the 2004 Act Sch 9 cl 18, needs the form adapted
- For instructions on or after 1 July 2015, the form says automatic assignment needs lodgment within 12 months of either the bill or the request for payment, or of payment if neither was made. The note says the 12 months runs from the last bill or the first request for payment, not both, and a later request does not restart it
- If the 12 months have passed, the extension request explains the delay and why an extension is just and fair
- Item 6 is the proper amount and does not subtract amounts paid. Item 7 is the difference between items 4 and 6. Objections are a separate document headed Objections. The forms page says there is no approved objections form
- The client or the client's legal practitioner signs section C before lodgment
- Health and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).
