Owner's letter to a builder giving written notice of defects under s 18BA of the Home Building Act 1989 (NSW), identifying the s 18B statutory warranties breached, offering access to rectify and recording the warranty periods in s 18E.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Construction & Infrastructure](https://ailawframework.com/precedents/construction-and-infrastructure.md)
- Jurisdictions: New South Wales

## When to use it

Use for a homeowner, successor in title or owners corporation as soon as defects in residential building work become apparent, and in any case within 6 months of that date, so the owner meets its duty to notify and keeps its claim within the 2-year or 6-year warranty period.

## How AI may be used

AI may build the defects schedule from the inspection report and photographs and fill the letter; a lawyer decides which warranties are breached, whether a defect is a major defect and the warranty dates.

**AI may:**

- Turn the building consultant's report into a numbered defects schedule with location, description, photograph reference and the expert's proposed rectification
- Extract the contract date, completion date, builder licence number and parties from the contract and occupation certificate
- Calculate candidate warranty end dates for the lawyer to confirm

**AI must not:**

- Must not classify a defect as a major defect or allocate it to a warranty without the lawyer and the building expert
- Must not describe a defect beyond what the expert report says
- Must not refuse, limit or set conditions on access for rectification beyond what the owner has instructed

**The lawyer checks:**

- The date each breach became apparent, so the 6-month notice duty in s 18BA(3)(a) is met
- Which s 18B warranties apply to each defect, and which defects are major defects within s 18E(4)
- The completion date and warranty end dates, including any extension under s 18E(1)(e)
- The client's standing (original owner, successor in title or non-contracting owner) and whether the builder is still trading or home building compensation cover should be notified
