A signed undertaking by each lawyer, staff member and contractor to follow the firm's AI confidentiality controls: approved tools only, no personal accounts, no bypassing controls or barriers, verification, incident reporting, monitoring and duties after leaving.

## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Confidentiality & client information](https://ailawframework.com/precedents/confidentiality-and-client-information.md)
- Jurisdictions: Australia
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the 4 authorities it cites, for Australia.

## When to use it

Use when onboarding staff and contractors, when the AI policy is adopted or materially changed, and annually. It supplements, and does not replace, the confidentiality terms in employment and contractor agreements.

## How AI may be used

AI may help keep the undertaking aligned with the current AI policy and track signatures. People decide who signs, what monitoring is lawful and how breaches are handled.

**AI may:**

- Compare the undertaking with the current AI policy and list differences after each policy change.
- Track which staff and contractors have signed and draft reminders.

**AI must not:**

- Must not be used to monitor individual staff in ways not covered by the firm's monitoring notice and applicable workplace surveillance law.
- Must not decide whether a breach has occurred or what disciplinary action follows.

**The lawyer checks:**

- Monitoring described in clause 9 is covered by a compliant workplace surveillance notice in each state where staff work.
- The undertaking is consistent with employment contracts, enterprise agreements and contractor terms.
- Contractors' own staff are bound, through the contractor agreement, to equivalent terms.
