## Key facts

- Practice area: [Confidentiality & client information](https://ailawframework.com/precedents/confidentiality-and-client-information.md)
- Jurisdictions: Australia, Victoria, Queensland, New South Wales
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the 2 authorities it cites, for 4 jurisdictions.

## When to use it

Give it when a plaintiff firm collects health information for an injury claim, from the client or from a treating practitioner, hospital or other person. Give it at or before collection, or as soon as practicable after if that is not practicable. It is not the consent to put records into an approved tool, and it is not the engagement clause on AI processing.

## How AI may be used

The tool can lay the APP 5 matters out as blanks. The lawyer confirms the practice should give the notice, writes the purposes and the usual disclosures, and decides whether a separate consent is required.

**AI may:**

- Set out the APP 5 matters as blanks for the lawyer to complete from the file
- Point to the separate consent used before medical records go into an approved tool
- Leave the law-or-order line, the consequences line and the overseas line empty until the lawyer completes them

**AI must not:**

- Must not decide that the practice is an APP entity
- Must not treat this notice as consent to collect or use health information
- Must not name a Health Privacy Principle or a state health-records period
- Must not add a recipient, a purpose or an overseas country that the lawyer has not written

**The lawyer checks:**

- The practice is an APP entity for this collection, or the notice is not sent as an APP 5 notice
- Each APP 5 matter is completed, or the lawyer has recorded why a step was not reasonable
- A separate consent is arranged where one is required, and this notice is not used in its place
