## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Commercial Property & Leasing](https://ailawframework.com/precedents/commercial-property-and-leasing.md)
- Jurisdictions: United States
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the authority it cites, for United States.

## When to use it

Use when a commercial lease or letter of intent states a use, or when the premises may serve the public. Do not use it to say that a zoning ordinance allows the use.

## How AI may be used

A tool may list the use in the client's words and the barriers described in a survey or a photograph the lawyer has added to the file.

**AI may:**

- Copy the permitted-use sentence from the draft
- List barriers a report already describes, under the priority headings in the primer
- Flag the zoning row when no ordinance excerpt is in the file

**AI must not:**

- Must not state that the use is permitted
- Must not decide that barrier removal is readily achievable
- Must not assign the work to landlord or tenant
- Must not treat the 1991 safe harbor as met without the lawyer identifying the element and the standard it met

**The lawyer checks:**

- The public-accommodation or commercial-facility label is the lawyer's
- Readily achievable is stated with the primer's definition and is decided from the business's size and resources, which the lawyer records
- Safe-harbor claims name the element and the 1991 work
- Zoning is recorded as unread until an ordinance excerpt is in the file
