Fill-in disclosure notice and certification for submissions in cases assigned to Judge Kelly at the Court of International Trade that contain text drafted with a generative AI program: program and portions identified, and no confidential or business proprietary information disclosed.

## Key facts

- Kind: Court document. A document filed or served in a court or tribunal.
- Practice area: [Commercial Litigation & Dispute Resolution](https://ailawframework.com/precedents/commercial-litigation-and-dispute-resolution.md)
- Jurisdictions: United States, United States federal courts
- AI level: Green. The tool writes the first draft inside a template you have already tested. You check it. Without that test, first drafting starts at Yellow.
- Law stated as at: 2026-11-07
- Status: Maintained. Checked on 2026-11-07 against the authority it cites, for United States and United States federal courts.

## When to use it

Use for any submission in a case assigned to Judge Kelly that contains text drafted with help from a generative AI program on the basis of natural language prompts. Other parties may then seek relief by motion. The court-wide CIT notice adds no general requirement; check other judges' chambers procedures.

## How AI may be used

A tool may lay out the judge's statement and fill in facts the signer gives it. The signer decides what to say about the AI use and makes the checks the statement describes.

**AI may:**

- Insert the tool name, version and uses the signer has recorded
- Insert only a version of the statement that the rule or order provides and that matches the signer's account of AI use
- Check that the statement sits where the rule or order says it must

**AI must not:**

- Must not state that citations, quotations or facts were checked; only the signer can say that after doing it
- Must not describe the AI use more narrowly than the file record shows
- Must not put prompts, privileged material or confidential client information in the statement
- Must not give the certification if any confidential or business proprietary information was entered into a tool whose terms allow access by others

**The lawyer checks:**

- The current judge's rule or order has been opened on the court's own site and matches the words used
- Every citation and quotation was checked by a person against an official or recognised source
- The statement is placed and signed as the rule requires, by the person the rule names
- The tool's data-retention and access terms were checked before any protected information was entered
