## When to use it

Use from 1 January 2027 on any document a California-licensed attorney submits to a court where generative AI was used in preparing it. The duty sits on the attorney and is not limited to state courts, so record whether the firm also uses it in federal court. Check the local rules and the assigned judge's orders as well. Some courts add their own terms, and a Judicial Council form may follow.

## How AI may be used

A tool may format the statement and fill in facts the attorney supplies. The attorney decides what to say about the tool and its use, and completes the citation line personally.

**AI may:**

- Insert the tool name and the uses the attorney has listed
- Choose the short or the fuller form as the attorney directs
- Check that the statement sits where the court's rules or the judge's order require

**AI must not:**

- Must not state that citations were verified
- Must not describe the use more narrowly than the attorney's record shows
- Must not include prompts, privileged material or client confidential information in the statement

**The lawyer checks:**

- The responsible attorney personally verified every citation before signing (Code Civ. Proc. 128.7(b)(2))
- The local rules and the assigned judge's orders have been checked for extra wording or placement
- The description of use is accurate and matches the firm's file record
