- Practice area: [Commercial Litigation & Dispute Resolution](https://ailawframework.com/precedents/commercial-litigation-and-dispute-resolution.md)
- Jurisdictions: Australia, Tasmania

- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the authority it cites, for Australia and Tasmania.

## When to use it

Use for a document prepared for a proceeding in the Supreme Court of Tasmania on or after 21 October 2026. The guidelines apply to all proceedings and to lawyers, litigants, witnesses, and other third parties who produce documents to the Court.

## Used for these tasks

## How AI may be used

Paragraph 3.6 requires an affidavit or witness statement to reflect the person's own knowledge, experience and words. The lawyer and the witness write that document. AI may keep the explanation note paragraph 4.5 expects the person to be able to give.

**AI may:**

- Record the tool, how it was used, and the checks a person made
- List the paragraph 4.2 verification items beside the draft

**AI must not:**

- Must not generate the affidavit, witness statement or the expert's opinion
- Must not add a certificate. Paragraph 4.4 says court users are not required to certify the use of Gen AI
- Must not rely on a Gen AI tool as the only check of AI-generated content
- Must not put confidential, privileged or suppressed information into a tool that is not a closed tool

**The lawyer checks:**

- The affidavit or witness statement reflects the person's own knowledge, experience and words, and is true to the best of that person's knowledge
- The expert report contains the expert's own opinion and reasoning, and the relevant practice direction and code are opened. They were not opened for this checklist
- Facts, evidence, cases, legislation, textbooks and articles have been checked by a person
- Images, video and sound have not been modified, enhanced or fabricated
- The person can explain, if asked, which tool was used, how, and what was done to check the content
