## When to use it

Use when preparing a statement of claim to start proceedings in the NSW Supreme, District or Local Court, or to accompany a Federal Court originating application. Always download the current form version from the official site on the day you prepare it; do not reuse an old copy.

## How AI may be used

AI may help map the material facts in a lawyer-approved facts brief against the elements of each cause of action, but the decision to plead each allegation, the certification and the final pleading belong to the lawyer.

**AI may:**

- Build a table of elements, material facts and source documents from the facts brief the lawyer has settled
- List particulars still needed and facts that appear only in the brief and in no document
- Check a draft for evidence pleaded as fact, inconsistent defined terms and missing parts of the approved form

**AI must not:**

- Must not plead a fact that is not in the facts brief or the documents
- Must not allege fraud or other serious misconduct unless the lawyer has decided there is a proper basis
- Must not be given subpoenaed, suppressed or compulsorily produced material unless the SC Gen 23 para 9A conditions are met
- Must not complete or sign the certificate as to reasonable prospects

**The lawyer checks:**

- Every allegation has a proper basis in provable facts and a reasonably arguable view of the law
- The form is the current version and every mandatory part is completed
- Party names, capacities and addresses for service are verified against registers
- Limitation, interest and relief claimed are correct and the genuine steps statement (Federal) is filed
