Original text for the parts of an interlocutory application the lawyer drafts around the approved form: orders sought, short minutes of order and an outline of submissions, with a compliance checklist covering service, evidence and the AI practice notes.

## Key facts

- Kind: Court document. A document filed or served in a court or tribunal.
- Practice area: [Commercial Litigation & Dispute Resolution](https://ailawframework.com/precedents/commercial-litigation-and-dispute-resolution.md)
- Jurisdictions: New South Wales, Australia, Queensland, Victoria
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the 8 authorities it cites, for 4 jurisdictions.

## When to use it

Use when seeking interlocutory orders, such as further discovery, an extension of time, security for costs or summary dismissal, in the NSW Supreme or District Court or the Federal Court. Put the orders into the current approved form. Do not use this pack to draft the supporting affidavit, which must be in the deponent's own words.

## How AI may be used

AI may draft the orders sought and an outline of submissions from the relief and facts brief the lawyer settles. It must not draft any part of the supporting affidavit, and a person must verify every authority and evidence reference.

**AI may:**

- Turn the lawyer's list of relief into numbered orders and matching short minutes
- Build an outline structure with proposed record citations from the evidence table the lawyer supplies
- Once the lawyer has written the affidavit, index its exhibits and list assertions with no source
- Check the orders, minutes and outline against each other for inconsistent dates, parties and defined terms

**AI must not:**

- Must not draft, outline or suggest wording for the supporting affidavit or any witness statement
- Must not add authorities or pinpoints that a lawyer has not read in the authorised source
- Must not be given suppressed, subpoenaed or compulsorily produced material unless the court's conditions are met
- Must not be relied on to verify its own citations

**The lawyer checks:**

- Each order is within power, precise and workable as drafted
- Every authority, pinpoint and quotation has been checked by a person against the authorised report or official register
- The NSW submission verification or Queensland responsible-person naming is included where it applies
- Service time, filed evidence and any duty of disclosure on an ex parte application are satisfied
