## When to use it

Use when starting a proceeding in the original jurisdiction of the Federal Court of Australia, unless a special form applies (for example judicial review, Fair Work, arbitration or representative proceedings, which have their own originating application forms).

## Used for these tasks

- [Draft pleadings from the facts-and-issues brief](https://ailawframework.com/practice/commercial-litigation-and-dispute-resolution/draft-pleadings-from-the-facts-and-issues-brief.md)
- [Check procedural citations against the court rules](https://ailawframework.com/practice/commercial-litigation-and-dispute-resolution/check-procedural-citations-against-the-court-rules.md)
- [Prepare an AI-use disclosure statement for a Federal Court filing](https://ailawframework.com/practice/commercial-litigation-and-dispute-resolution.md#A5-B8-1)

## How AI may be used

AI may help draft the relief claimed from the lawyer's case theory and check the application against the rules; the lawyer settles every order sought and every allegation and checks each instance before filing.

**AI may:**

- Check that the application includes the applicant's name, address and address for service, and any representative capacity (r 8.01(2))
- Draft the list of relief sought from the lawyer's case outline, for the lawyer to settle
- Check whether a special originating application form applies to the cause of action and flag it
- Check that the accompanying statement of claim or affidavit is filed with it (r 8.05)

**AI must not:**

- Must not choose the cause of action, the parties or the relief
- Must not draft the accompanying affidavit (sworn evidence)
- Must not sign the migration certificate under r 8.04

**The lawyer checks:**

- Correct form: Form 15, or the special originating application the Rules require
- Damages claimed: accompanied by a statement of claim (Form 17) unless a practice note requires or permits another document
- No damages: accompanied by a statement of claim or an affidavit stating the material facts for fair notice
- Every authority and legislative reference checked against the source, and any AI disclosure the Court requires made
- Filing fee paid at the correct rate (corporation or other)
