## When to use it

Use when an area-based emissions avoidance or sequestration project is being registered or varied, and again before the end of the first reporting period if registration was conditional.

## Used for these tasks

- [Build the eligible interest-holder consent register for a carbon project](https://ailawframework.com/practice/climate-esg-and-sustainability-reporting.md#A48-D20261018-3)

## How AI may be used

AI may list interest holders from the title searches and the Carbon Credits Act sections 43 to 45A; the lawyer checks every row and decides whether the consent is required and has been given.

**AI may:**

- Add a row for each mortgage, easement, Crown interest or native title entry appearing on a search the lawyer has obtained
- Flag a row with no signed consent form and a first reporting period end date that has been entered
- Record that an easement was excluded from the project area map, where the file says so

**AI must not:**

- Must not mark a consent as sufficient, or state that the project may receive ACCUs
- Must not describe the project to an interest-holder or draft the consent form
- Must not treat a commercial term about sharing ACCUs as if it were the statutory consent

**The lawyer checks:**

- Every interest of the kinds the Regulator describes has been searched for, and sections 43 to 45A of the Carbon Credits (Carbon Farming Initiative) Act 2011 have been read against the searches
- Each consent is the Regulator's form, or is in a registered Indigenous land use agreement, as the Regulator's page allows
- Conditional registration is recorded, and the first reporting period end date is the date on the registration, not an assumed date
- A new area added to a sequestration project has its own consents, including from holders who the Regulator says must consent even if they have no interest in the land being added
