A letter and decision record for a person issued with a CASA aviation infringement notice: pay, or have the matter dealt with by a court, with demerit points and the penalty figures checked against the notice and CASA's current page.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Aviation, Drones & Space](https://ailawframework.com/precedents/aviation-drones-and-space.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the 2 authorities it cites, for Australia and Commonwealth.

## When to use it

Use when CASA has issued an aviation infringement notice. Diary the date printed on the notice. Do not use this letter for a show cause notice about varying, suspending or cancelling an authorisation. That is a different process.

## Used for these tasks

## How AI may be used

AI may extract the offence, the amount and the due date from the notice into the decision record. The lawyer decides whether to pay or to contest, and writes any explanation that is sent.

**AI may:**

- Copy the notice number, offence, amount, due date and authorisation number into the record
- List what CASA's page says paying does, and what a court election does, beside the client's instructions
- Add the client's existing demerit points only if they are on a CASA record in the file

**AI must not:**

- Must not recommend paying or contesting
- Must not admit the offence in a draft that might be sent
- Must not calculate a court penalty except from the notice and the current penalty unit

**The lawyer checks:**

- The document is an infringement notice and not a show cause notice
- The due date is the date on the notice. No period is assumed
- Demerit points and any suspension threshold are checked against the notice and the current enforcement manual chapters CASA cites
- The client has chosen, in writing, to pay or to have the matter dealt with by a court
