Checklist for a sublease or licence at a leased federal airport: consistency with the approved master plan, major development plan triggers, environment strategy and ANEF points, building control, and the commercial terms that interact with them.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Aviation, Drones & Space](https://ailawframework.com/precedents/aviation-drones-and-space.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 2 authorities it cites, for Australia and Commonwealth.

## When to use it

Use when acting for a retailer, operator, logistics or hangar tenant, or developer taking a sublease or licence at a leased federal airport, or for the airport-lessee company preparing one. It covers the federal planning overlay; use the ordinary commercial lease review for the rest of the document.

## How AI may be used

AI may extract the sublease or licence terms and the relevant land use, zoning and development content of the published master plan into the checklist; the lawyer decides whether the proposed use and works fit the planning framework and what protections the client needs.

**AI may:**

- Extract permitted use, term, works obligations, approvals conditions, relocation, make-good and termination clauses into Part C
- Find and quote the land use precinct, zoning and development plans for the site in the airport’s current approved master plan
- Compare the proposed works with the major development categories listed in the Department’s guidance and flag possible triggers

**AI must not:**

- Must not decide whether a development is a major airport development or is consistent with the master plan; that is a legal judgement on the Act and the plan
- Must not rely on a draft or superseded master plan without saying so
- Must not assume that state planning or council approvals are needed or not needed on airport land; flag for the lawyer

**The lawyer checks:**

- The approved master plan in force (not a preliminary draft) has been checked for the site’s precinct and permitted uses
- Whether the client’s works could be a major airport development, and who bears the time and cost risk of a major development plan, is dealt with in the document
- Building and works approvals under the airport building control regime, and airport-lessee company consents, are conditions the client can satisfy
- Relocation, redevelopment and termination rights reflect the master plan’s future land use for the site
