## When to use it

Use when the Commission has notified a respondent of a complaint under the federal discrimination Acts and asked for a response. Do not use for a state anti-discrimination body without changing the statutory framework, time limits and costs position.

## How AI may be used

AI can organise the complaint's allegations against the evidence and draft a first response, but the letter is a representation to a statutory body: every statement must be verified with the client and documents, and the lawyer decides what to admit.

**AI may:**

- Extract each allegation from the complaint into a table in the complainant's own words, with dates and people named.
- Map documents the lawyer has cleared (emails, rosters, policies, investigation report) to each allegation with references.
- Draft neutral factual responses for the lawyer to verify with the client.

**AI must not:**

- Must not characterise the complainant's motives, health or credibility.
- Must not be given the complainant's medical records or other sensitive information in a tool that is not approved for health information.
- Must not decide what to admit or deny, or invent facts to fill gaps in the client's account.

**The lawyer checks:**

- Every factual statement is confirmed by the client and, where possible, a document.
- Jurisdiction and time points (including the 24-month termination ground) are checked against the complaint dates.
- The client understands that the response is usually provided to the complainant and that false or misleading information is an offence.
- The costs position under s 46PSA has been explained before any court risk is assessed.
