## Checking plan

**Verify against sources**

The lawyer confirms the file is a Victim Assist application under the 2009 Act. The tool records the date of the act and the court outcome.

- What the AI does: From the file, record the date of the act of violence, the body named on any application, and whether anyone was convicted or pleaded guilty. Do not apply a handover date from another scheme.
- What the lawyer does: Decide whether the file is eligible under the guide's date split.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The opened guide and Act do not describe a tribunal that stopped taking new applications, or a date on which files moved to a new body. Applications are assessed under the Victims of Crime Assistance Act 2009.
2. For an act of violence after 1 December 2009, the guide says the offender does not need to be convicted.
3. For an act before that date, the guide requires a conviction or guilty plea in the District or Supreme Court, a police statement that the offender could not be located, or the Mental Health Review Tribunal path.
4. A later challenge uses internal review under s 124 and then QCAT under s 125. It is not a transfer of the file to a new scheme.

## Notes

- Do not look for a pre-November 2024 tribunal file unless the documents themselves name one.
- The conviction split is about eligibility. It is not a limitation period.
- Health records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victim Assist Queensland under the Victims of Crime Assistance Act 2009

**Deliverable**: A note of the date of the act and the court outcome, with no handover date applied.

**Inputs**

- The application and the date of the act
- Any conviction or police statement
- The Queensland guide

**Example**: Illustrative example: The act was in 2016 and there is no conviction. The note records that the guide does not require a conviction for an act after 1 December 2009. It does not move the file to another body.

**Stop and escalate when**

- The date of the act is unknown.
- The act was before 1 December 2009 and none of the three eligibility paths is on the file.
