## Checking plan

**Verify against sources**

Section 124 gives 28 days after notice to apply to the scheme manager and requires a detailed basis. The lawyer writes that basis.

- What the AI does: From the notice, list the decision, the date notice was given, the date 28 days later, and the documents the lawyer marks. Do not write the basis of the grievance.
- What the lawyer does: The lawyer decides that the decision is reviewable, writes the basis required by section 124, and settles the application.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Confirm the decision is one identified in schedule 1 before an internal review is requested.
2. Count 28 days from when the applicant was given notice, not from the date of the violence.
3. Leave the basis blank for the lawyer. Section 124 requires the application to state in detail the basis on which the applicant is aggrieved.
4. If the 28 days have passed, record that the scheme manager may extend time if it is reasonable. Do not write the extension grounds.

## Notes

- Section 124 is an application to the scheme manager. Do not describe it as a court appeal.
- The in-force Act is the reprint current from 2 October 2024. Check schedule 1 in that reprint.

## Practical guide

Jurisdiction: Victim Assist Queensland, scheme manager

**Deliverable**: An internal review worksheet with the statutory basis left for the lawyer.

**Inputs**

- Notice of the decision
- Date notice was given
- Schedule 1 as checked by the lawyer

**Example**: Illustrative example: Notice of a refusal was given on 1 October. The worksheet records 29 October as the 28-day date and that the lawyer must check schedule 1. The detailed basis is blank.

**Stop and escalate when**

- Schedule 1 has not been checked.
- The draft states a basis the lawyer has not written.

Checked 2026-10-23.
