## Checking plan

**Verify against sources**

The lawyer decides the representative and the payment destination. The tool records only what the documents already say.

- What the AI does: From the age documents and any authority already on the file, record the date of birth, whether an adult is named, and whether the child has asked to apply alone. Do not decide who may apply and do not complete the form.
- What the lawyer does: Decide who has authority to apply and where the money must be sent.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The violent act must have happened in Victoria. In most cases a trusted adult helps. A child may ask to apply alone, and the scheme considers age, who they live with, why, and whether they usually decide for themselves.
2. An authorised representative must be over 18 and cannot be a service provider providing supports, such as a counsellor. A lawyer, carer, guardian or other trusted adult may apply, update the application, provide documents and communicate.
3. Counselling, medical, safety and other urgent expenses are paid to the service provider. Some other payments go to the young person's account only if they are over 18, and otherwise to a parent or guardian.
4. Payment may instead go to Funds in Court, held by the Senior Master of the Supreme Court. Access then needs an application to the Court.

## Notes

- If the applicant turns 18 while the application is being assessed, the page says they may keep the representative or manage the application themselves.
- The opened page does not say a child can be required to apply alone.
- Health records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victorian Financial Assistance Scheme, applications by children and young people

**Deliverable**: A note of the child's age, the adult named on the file, and the payment destination the page allows.

**Inputs**

- Proof of age
- Any authority already on the file
- The children and young people page

**Example**: Illustrative example: The file names a counsellor as the person who will sign. The note records that a treating counsellor cannot be the authorised representative. It does not choose a replacement.

**Stop and escalate when**

- There is no proof of age.
- The proposed representative is a treating provider and no other adult is named.
