## Checking plan

**Verify against sources**

The lawyer decides authority and the account. The tool records age and the adult named on the file.

- What the AI does: From the age documents and any authority already on the file, record the date of birth, whether a parent or guardian is named, and whether a family member or friend is an authorised representative. Do not decide who may apply and do not complete the form.
- What the lawyer does: Decide who has authority to apply and where the payment is sent.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. If the applicant is under 18, the recognition page requires the child's identification and the parent or guardian's identification.
2. The bank account is in the applicant's name, or in a parent, step-parent or guardian's name if the victim is under 18. If a family member or friend is an authorised representative, that person's identification is also required.
3. A recognition payment approved while the applicant is under 18 is paid to the NSW Trustee and Guardian to hold until the applicant turns 18.
4. The page's 12-month rule for a medical, dental or counselling report is stated for a primary victim. Do not copy it onto a family-victim file from this page. The family-victim document list is on a page that was not opened.

## Notes

- The opened page does not list a counsellor as someone who may sign.
- The scheme overview was opened for who administers the scheme. The rule that a recognition payment is held until 18 is on the recognition page. How the NSW Trustee and Guardian manages the money was not opened.
- Identification and health records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales Victims Support Scheme, recognition payments for applicants under 18

**Deliverable**: A note of the child's age, the adult named on the file, and that an approved recognition payment is held until 18.

**Inputs**

- Proof of age and identification
- Any authority already on the file
- The recognition-payment page

**Example**: Illustrative example: The applicant is 15 and a parent is named. The note records that a recognition payment approved now would be paid to the NSW Trustee and Guardian until the applicant turns 18. It does not complete the form.

**Stop and escalate when**

- There is no proof of age.
- No parent, guardian or other authorised adult is named.

Checked 2026-10-23.
