## Checking plan

**Verify against sources**

The lawyer decides whether the violent act is proved. The tool records the court outcome and does not treat a conviction as a condition.

- What the AI does: From the charge sheet, the court outcome and the report the lawyer marks, record whether anyone was convicted or pleaded guilty, the court, and the date. Do not decide that the scheme can pay.
- What the lawyer does: Decide whether the violent act is proved to the scheme.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Guideline 3 says the scheme must be satisfied a violent act occurred, and that the application must say when it occurred. The opened guideline does not list a conviction as a condition.
2. Record the charge, plea and outcome because the lawyer may need them. Do not write that the scheme will refuse, or will pay, because of that outcome.
3. Guideline 3.1 then sets the time from the violent act, or the last related act if there is more than one. An omitted act cannot be paid. That is a time rule, not a conviction rule.
4. Do not import a conviction rule from another scheme into this file.

## Notes

- The guideline does not say the absence of a conviction is sufficient.
- The standard the scheme uses to be satisfied of the violent act is not spelled out on the page that was opened. The lawyer applies the Act.
- Charge sheets and medical reports stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victorian Financial Assistance Scheme, proof of the violent act

**Deliverable**: A note of the court outcome beside the statement that the opened guideline does not require a conviction.

**Inputs**

- Charge sheet and court outcome
- The report the lawyer marks
- Guideline 3

**Example**: Illustrative example: The criminal case did not end in a conviction. The note records that fact and that guideline 3 does not list a conviction as a condition. It does not say the application will succeed.

**Stop and escalate when**

- There is no record of whether a charge was laid.
- The date of the violent act is not known.

Checked 2026-10-23.
