## Checking plan

**Verify against sources**

The lawyer decides eligibility. The tool records the date of the act, the report, and the court outcome.

- What the AI does: From the charge sheet, the court outcome and the report the lawyer marks, record whether anyone was convicted or pleaded guilty, the court, and the date of the act. Do not decide that the scheme can pay.
- What the lawyer does: Decide whether the guide's conviction and reporting rules are met.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. For an act after 1 December 2009, the guide says the offender does not need to be convicted. For an act before that date, eligibility needs a conviction or guilty plea in the District or Supreme Court, a police statement that the offender could not be located, or the Mental Health Review Tribunal path.
2. A primary victim is a person directly injured by an act of violence in Queensland. Victims other than a special primary victim must report to police before applying.
3. A special primary victim includes a person who was a child, who has impaired capacity, or who was threatened or intimidated, and also victims of sexual offences, offences by a person in a position of power, influence or trust, and domestic violence after 1 July 2017. They may report to a doctor, counsellor, psychologist, psychiatrist or domestic violence service, or to police.
4. Record the court outcome. Do not treat it as a condition the guide does not impose for an act after 1 December 2009.

## Notes

- The guide says plead guilty. It specifies the District or Supreme Court for the pre-2009 path. Do not add another court.
- Section 141A is a notice of another payment. It is not the conviction or reporting rule. Absence of a conviction is not, by itself, a decision that assistance will be paid.
- Medical and counselling reports stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victim Assist Queensland, reporting and conviction

**Deliverable**: A note of the date of the act, how it was reported, and the court outcome.

**Inputs**

- Charge sheet and court outcome
- The report the lawyer marks
- The Queensland guide

**Example**: Illustrative example: The act was in 2008 and the only court outcome is a plea in the Magistrates Court. The note records that the guide's pre-2009 path names the District or Supreme Court. It does not say the application will fail.

**Stop and escalate when**

- The date of the act is unknown.
- There is no record of a report to police or, for a special primary victim, to one of the other services.

Checked 2026-10-23.
