| How AI is used | From the charge sheet, the court outcome and the report the lawyer marks, record whether anyone was convicted or pleaded guilty, and which report is on the file. Do not decide that the scheme can pay. |
| What the lawyer must review | Do not add a conviction condition. The recognition page does not list one. Apply the report and the 12-month rule on that page to a primary victim. Do not copy that document list onto a family victim. Their list is on a page that was not opened Use a firm-controlled tool for health records. ASCR r 9, APP 11 and the Privacy Act 1988 (Cth) apply. |

## Checking plan

**Verify against sources**

The lawyer decides whether the supporting report is sufficient. The tool records the report and the court outcome.

- What the AI does: From the charge sheet, the court outcome and the report the lawyer marks, record whether anyone was convicted or pleaded guilty, and which report is on the file. Do not decide that the scheme can pay.
- What the lawyer does: Decide whether the report the page requires is on the file.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. A primary victim needs a report that explains what happened. That may be a police report, a report from a government organisation, or a report from a government-funded organisation.
2. If the incident was reported to NSW Police, the police report itself need not be sent. The form can give the report details.
3. A primary victim also needs a medical, dental or counselling report. It may be provided up to 12 months after lodgement. If it is not, the recognition application is closed.
4. The page says family victims of homicide need a different set of supporting documents, and points to another page. That page was not opened. Do not apply the 12-month rule to a family victim from this page. The page does not list a conviction as a condition.

## Notes

- Absence of a conviction is not, by itself, a decision that the payment will be made.
- Modern slavery is a separate class on the page, for acts on or after 1 January 2022. Do not fold it into an assault file.
- Medical and counselling reports stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales Victims Support Scheme, recognition-payment documents

**Deliverable**: A note of the report on the file, the 12-month date if the applicant is a primary victim, and the court outcome.

**Inputs**

- The report the lawyer marks
- Charge sheet and court outcome
- Lodgement date

**Example**: Illustrative example: A primary-victim application was lodged on 1 March without a medical report. The note records 1 March next year as the 12-month date on the page. It does not say the application will be granted.

**Stop and escalate when**

- It is not clear whether the applicant is a primary victim or a family victim.
- There is no lodgement date.
