## Checking plan

**Verify against sources**

The lawyer writes anything lodged at QCAT. The tool lists the decision and the documents.

- What the AI does: From the internal review decision and the documents already lodged, list the decision, the date of the information notice, and the documents the lawyer marks. Do not write the grounds, do not state a QCAT filing period, and do not write anything that is lodged.
- What the lawyer does: Write the grounds and take the QCAT period from the Act and the notice.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 124 lets an applicant seek internal review of a decision identified in schedule 1 within 28 days after notice. The scheme manager may extend that time. The review does not stay the decision. It must be decided within 42 days, and the reviewer must give a QCAT information notice.
2. Section 125 then lets the applicant apply to QCAT, as provided under the QCAT Act, to review that internal review decision. The note to s 125 points to s 22(3) of the QCAT Act for a stay.
3. The opened section does not state the QCAT filing period. Take it from the information notice and the QCAT Act.
4. For a government assessor's decision, the reviewer is the scheme manager or another government assessor the scheme manager nominates. For a scheme manager's decision, the reviewer is a departmental employee of the same or higher classification nominated by the chief executive, and that decision is taken to be the scheme manager's.

## Notes

- Practice Direction No 10 of 2025 requires the responsible person to be named at the end of written submissions. Where that person is a lawyer, the individual must be named. Naming the firm is not enough. By being named, the lawyer informs the tribunal that references have been verified.
- The QCAT artificial-intelligence page says prompts entered into a public chatbot are not kept confidential, and that the words of a witness statement or affidavit are the witness's own evidence. Do not put the victim's account into a public tool. The list from this task is not the submission.
- Health records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland Civil and Administrative Tribunal review of an internal review under the Victims of Crime Assistance Act 2009

**Deliverable**: A list of the internal review decision, the information-notice date and the documents. The lawyer writes the grounds.

**Inputs**

- Section 124 decision and the QCAT information notice
- Documents already lodged
- Practice Direction No 10 of 2025

**Example**: Illustrative example: The information notice gives a date and does not restate a number of days. The list records the date and leaves the filing period blank for the lawyer to take from the QCAT Act and the notice. It does not draft grounds.

**Stop and escalate when**

- There is no internal review decision yet.
- The information notice is missing.

Checked 2026-10-23.
