## Checking plan

**Verify against sources**

The lawyer confirms eligibility under the Victims of Crime Assistance Act 2009 and the payment types on the government guide. The tool does not describe the violence.

- What the AI does: From the lawyer's register and the documents the lawyer marks, complete the Victim Assist Queensland fields for identity, the victim type, the payments sought and the attachments. Do not write what happened to the client.
- What the lawyer does: The lawyer decides the victim type and the payments sought, checks the application against the Victims of Crime Assistance Act 2009 and the guide, and confirms the client approves it.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Confirm whether the applicant is a primary victim, a special primary victim, a related victim, a parent secondary victim or a witness, because the guide gives each a different set of payments.
2. Check reporting. All victims except special primary victims must report to police. A special primary victim may report to a doctor, counsellor, psychologist, psychiatrist or domestic violence service.
3. Apply section 54: 3 years after the act, 3 years after the death for a related victim, or, for a child, 3 years after the day the child turns 18.
4. For violence before 1 December 2009, use the guide's extra eligibility limits, including conviction or a stated police or tribunal outcome. For later violence, a conviction is not required.
5. If the victim is under 18 or has an appointed trustee, record that payment goes to the Queensland Public Trustee.

## Notes

- The in-force Act page is the reprint current from 2 October 2024. Read that reprint before relying on a category amount.
- This is an application to the scheme manager, not a court document. Queensland Courts' generative AI page applies if the same facts later support a civil claim.

## Practical guide

Jurisdiction: Victim Assist Queensland under the Victims of Crime Assistance Act 2009

**Deliverable**: A draft financial assistance application with the account of the violence left blank.

**Inputs**

- Lawyer's eligibility register
- Police or other report the lawyer accepts
- Medical and expense documents marked for attachment

**Example**: Illustrative example: A primary victim seeks a special assistance payment and recovery expenses. The draft names those payment types and lists the report. It does not describe the violence. The lawyer checks section 54 and whether the Public Trustee must receive the payment.

**Stop and escalate when**

- The violence has not been reported in a way the guide accepts.
- The draft describes the act of violence.

Checked 2026-10-23.
