## Checking plan

**Verify against sources**

The lawyer chooses the kind of victims support and checks the published time limit and documents. The tool does not describe the violence.

- What the AI does: From the lawyer's register and the documents the lawyer marks, complete the Victims Support Scheme fields for the support sought and the attachments. Do not write what happened to the client.
- What the lawyer does: The lawyer decides which support is sought, checks the fields and documents, and confirms the client approves the application.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Separate counselling, which the scheme page says has no time limit, from financial assistance and a recognition payment, which do.
2. For a recognition payment, use the recognition-payment page: 10 years for domestic violence or sexual assault, 2 years for other violent crime or modern slavery, with the child and homicide variants on that page.
3. For a primary victim's recognition payment, include a report of what happened and a medical, dental or counselling report showing the effect. If the effect report is not ready, record the published 12-month period to provide it.
4. If a recognition payment would be approved for a person under 18, record that it is paid to NSW Trustee and Guardian until the person turns 18.
5. Do not choose a recognition-payment amount. The published amounts turn on the type of violence.

## Notes

- The scheme pages call the statute the Victims Support Act 2013. The instrument is the Victims Rights and Support Act 2013. Read the current Act before relying on a section number that these pages do not state.
- Practice Note SC Gen 23 does not govern Victims Services. It applies if a later document is prepared for the Supreme Court.

## Practical guide

Jurisdiction: NSW Victims Support Scheme, Victims Services

**Deliverable**: A draft victims support application with the account of the violence left blank.

**Inputs**

- Lawyer's eligibility register
- Report of what happened
- Medical, dental or counselling report, if a recognition payment is sought

**Example**: Illustrative example: A primary victim seeks a recognition payment after a violent robbery. The draft lists the report of what happened and notes that the effect report is still to come. It does not choose the $1,500 or another amount. The lawyer checks the two-year limit and the 12-month period for the effect report.

**Stop and escalate when**

- The kind of support is not identified, so the time limit cannot be checked.
- The draft describes what happened to the client.

Checked 2026-10-23.
