## Checking plan

**Verify against sources**

Special financial assistance is for a primary victim, outside the ordinary assistance pool, and the categories sit in the regulations. The tool does not choose the category.

- What the AI does: Quote each injury description from the reports the lawyer marks, with the report name and page, beside the special financial assistance descriptors the lawyer supplies. Do not choose a category or an amount.
- What the lawyer does: The lawyer chooses the category, checks the report extracts, and decides what is sent to the scheme.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Confirm the applicant is a primary victim. The guidelines say secondary and related victims are not eligible for special financial assistance.
2. Record whether the violent act was committed against the victim, or the victim was a child injured by exposure to it, and whether a significant adverse effect is described. Significant adverse effect includes grief, distress, trauma or injury.
3. Do not assign a dollar figure from a report. The primary victims page states up to $20,000 for a single offence and $25,000 for multiple offences, and says the amount depends on the type of crime and the circumstances.
4. Take the categories and the minimum and maximum amounts from the Victims of Crime (Financial Assistance Scheme) Regulations 2024. The guidelines say they do not override the regulations.

## Notes

- A person injured while trying to arrest, prevent a violent act, or rescue someone is not the starting point for special financial assistance, because the act was not committed against them. The lawyer decides whether the facts differ.
- Special financial assistance is not paid as interim assistance.

## Practical guide

Jurisdiction: Victorian Financial Assistance Scheme, special financial assistance

**Deliverable**: A comparison table of report extracts against the descriptors the lawyer supplies.

**Inputs**

- Medical, dental or counselling reports
- Category descriptors taken by the lawyer from the 2024 regulations
- Lawyer's note on whether there was one offence or more

**Example**: Illustrative example: A report describes a fracture and ongoing distress after one assault. The table quotes that passage and leaves the category blank. The lawyer checks the regulations before any amount is written.

**Stop and escalate when**

- The regulations have not been opened for the category.
- The applicant is not a primary victim.
