| How AI is used | List property to be returned, the owner, medical and therapy costs, and lost income, each tied to a document. Do not draft the restitution order or the request. |
| What the lawyer must review | 18 U.S.C. § 3663A(a) requires the court, when sentencing a defendant convicted of an offense described in subsection (c), to order restitution to the victim or, if the victim is deceased, to the victim's estate. The victim is a person directly and proximately harmed as a result of the commission of the offense. For property, the order shall require return of the property or, if return is impossible, impracticable, or inadequate, payment of the greater of the value on the date of damage, loss, or destruction or the value on the date of sentencing, less the value of any part returned. For bodily injury the order covers necessary medical and related professional services, necessary physical and occupational therapy and rehabilitation, and income lost as a result of the offense. 18 U.S.C. § 3771(a)(6) separately states the right to full and timely restitution as provided in law. You decide whether subsection (c) applies and what is necessary. |

## Checking plan

- What the AI does: List property to be returned, the owner, medical and therapy costs, and lost income, each tied to a document. Do not draft the restitution order or the request.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- If the victim is under 18, incompetent, incapacitated, or deceased, a representative may assume the victim's rights, and the defendant shall not be named as that representative.
- Subsection (c)(3) allows the court to find restitution impracticable where the number of identifiable victims of certain property offenses is so large. Read that paragraph before assuming an order must issue.
