## Checking plan

**Verify against sources**

A late Victorian application must explain the delay. The scheme must consider the reasons the guidelines list. The lawyer writes the explanation.

- What the AI does: Set out the incident date, the ordinary limit for that applicant, the date of the application, and the date of each report the lawyer marks about the delay. Do not write the explanation.
- What the lawyer does: The lawyer decides whether to seek an extension, writes the explanation, and checks the supporting material.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. State the ordinary limit first. An adult has 10 years from the last violent act for a sexual offence or family violence, and 3 years from the last violent act for other offending. A child victim of child abuse or family violence has no time limit. Any other child victim must apply before turning 21. Do not ask for more time if there is no limit.
2. The guidelines say the applicant must give details in the application and evidence or information explaining the delay.
3. List only the delay facts in the marked reports. Reasons the scheme must consider include age, intellectual disability or mental illness, a position of power, the effect of the act, a condition affecting the ability to apply, a pattern of abuse, homelessness, the time to finish related legal proceedings, and whether the delay compromises a fair decision.
4. Do not copy the named examples on the guidelines page into the client's explanation.

## Notes

- The guidelines say that without reasons the scheme cannot extend time. Silence is not a request.
- This is not the 28-day internal review of a decision already made.

## Practical guide

Jurisdiction: Victorian Financial Assistance Scheme, out of time applications

**Deliverable**: A delay chronology and a blank explanation for the lawyer.

**Inputs**

- Ordinary deadline the lawyer has calculated
- Reports marked as explaining the delay
- Draft application date

**Example**: Illustrative example: An adult victim of an assault is two years past the three-year limit. The chronology lists the trial end date and a medical report about recovery. The explanation of why that caused the delay is left blank.

**Stop and escalate when**

- No document explains the delay.
- The ordinary limit has not expired, or there is no limit.
