| What the lawyer must review | The lawyer applies sections 120 and 121, decides whether the transfer is at risk of being void if the transferor later becomes bankrupt, and writes the advice. |

## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: From the transfer documents, the trust deed and the financial records the lawyer selects, build a table of the date, the property, the consideration, whether the transferee is a related entity of the transferor, and any record of insolvency. Do not write the advice.
- What the lawyer does: The lawyer applies sections 120 and 121, decides whether the transfer is at risk of being void if the transferor later becomes bankrupt, and writes the advice.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Check the date, property and consideration against the transfer documents.
2. Under section 120, record the five-year period and the shorter periods in which solvency is a defence, including the four-year period for a related entity.
3. Under section 121, record whether the main purpose of defeating creditors can be inferred from insolvency at the time of the transfer.
4. The lawyer writes the advice. The table is not the advice.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
