## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Trusts & Estate Planning](https://ailawframework.com/practice/trusts-and-estate-planning.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | Index the trust, the consents and the purpose the client wants changed. Write no petition, proposed order or brief. |
| What the lawyer must review | You write and sign the petition. In a state that has enacted Uniform Trust Code § 411, modification of a noncharitable irrevocable trust by the beneficiaries alone requires the court to conclude that the change is not inconsistent with a material purpose, and termination requires the court to conclude that continuance is not necessary to achieve any material purpose. Consent of the settlor and all beneficiaries is a different path (§ 411(a)). A spendthrift clause is not presumed to be a material purpose (§ 411(c)). Other states use different tests. In federal court, Rule 11 is your certification that the legal contentions are warranted after a reasonable inquiry. Model Rule 3.3 forbids a false statement of law to the tribunal. Opinion 512: do not file generated analysis or citations you have not opened. |

## Checking plan

- What the AI does: Index the trust, the consents and the purpose the client wants changed. Write no petition, proposed order or brief.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Most trust petitions are in state court. Rule 11 applies when the paper is filed in federal court.
- Do not assume the state enacted Uniform Trust Code § 411.
