| How AI is used | From the mark file and the domain record the lawyer supplies, list the mark, the domain name, the registration date shown, and the facts in the file that bear on intent. Write no complaint. |
| What the lawyer must review | 15 U.S.C. § 1125(d)(1)(A): a person is liable in a civil action by the owner of a mark, including a personal name protected as a mark, if that person has a bad faith intent to profit from the mark and registers, traffics in, or uses a domain name that, for a mark distinctive at the time of registration of the domain name, is identical or confusingly similar to that mark, or, for a mark famous at that time, is identical or confusingly similar to or dilutive of that mark. Subsection (d)(1)(B) lists factors a court may consider on bad faith, and it says bad faith shall not be found where the court determines the person believed, and had reasonable grounds to believe, that the use was a fair use or otherwise lawful. Subsection (d)(1)(C) authorises a court to order forfeiture, cancellation, or transfer of the domain name. The lawyer writes the complaint. Federal Rule of Civil Procedure 11(b) is the certification. This is a federal civil action, not a registry complaint. |

## Checking plan

- What the AI does: From the mark file and the domain record the lawyer supplies, list the mark, the domain name, the registration date shown, and the facts in the file that bear on intent. Write no complaint.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- The in rem path in § 1125(d)(2) was read only far enough to see that it is a separate action against the domain name in a stated district. The lawyer opens that subsection before using it.
- A country-code complaint procedure was not opened. Do not prepare a .au or UDRP complaint from this entry.
- Liability for use under § 1125(d)(1)(D) is limited to the registrant or the registrant’s authorized licensee.
