| How AI is used | Place the parties, the plan name and the share or amount from the settlement into a checklist of the statutory elements. Do not file an order. |
| What the lawyer must review | ERISA’s anti-assignment rule yields to a qualified domestic relations order (29 U.S.C. § 1056(d)(3)). A domestic relations order is a judgment, decree or order, including approval of a property settlement, made under state domestic-relations law, that relates to child support, alimony or marital property rights and that assigns plan benefits. It is qualified only if it creates or recognises an alternate payee’s right and clearly specifies the participant’s and each alternate payee’s name and last known mailing address, the amount or percentage or the way to determine it, the number of payments or the period, and each plan to which it applies, and if it meets the limits in § 1056(d)(3)(D). The plan administrator must notify the participant and each alternate payee of receipt and, within a reasonable period, determine whether the order is qualified. You check every element against the plan and the statute before anyone signs or files. Individual retirement accounts that are not ERISA plans use a different instrument. |

## Checking plan

- What the AI does: Place the parties, the plan name and the share or amount from the settlement into a checklist of the statutory elements. Do not file an order.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- Do not call an order qualified before the plan administrator determines that it is.
- Do not use an Australian superannuation-splitting notice. There is no Superannuation Guarantee in this task.
