## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Superannuation](https://ailawframework.com/practice/superannuation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the employment dates and the decision letters the lawyer marks, build a time-limit table: date employment ended, date the claim was lodged with the decision maker, date of the original decision, and the resulting AFCA deadline. The tool does not write the complaint. |
| What the lawyer must review | Fix the date employment ended and the date of the original decision, not a later review. Apply rule B.4.1.1. AFCA cannot extend the limits in rules B.4.1.1 to B.4.1.4. If the superannuation limit is missed, check a complaint against the insurer alone. Do not put medical records into a public tool. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to the policy, the fund records and the linked primary sources, and check for material the output has missed.

- What the AI does: From the employment dates and the decision letters the lawyer marks, build a time-limit table: date employment ended, date the claim was lodged with the decision maker, date of the original decision, and the resulting AFCA deadline. The tool does not write the complaint.
- What the lawyer does: Fix the date employment ended and the date of the original decision, not a later review. Apply rule B.4.1.1. AFCA cannot extend the limits in rules B.4.1.1 to B.4.1.4. If the superannuation limit is missed, check a complaint against the insurer alone. Do not put medical records into a public tool.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Rule B.4.1.1(a): if employment ended because of the condition, the claim must have been made within two years of permanently ceasing employment, and the complaint within four years of the decision.
2. Rule B.4.1.1(b): if employment did not end because of the condition, the complaint must be within six years of the decision.
3. Rule B.4.1.2: a later confirmation or substitution is still the original decision, made when the original decision was made.
4. Rule B.4.4.1: AFCA will not extend the limits in rules B.4.1.1 to B.4.1.4.
5. The 12 March 2026 operational guidelines say the two-year claim period runs from formal termination, not the last day worked. Confirm that explanation in the guidelines now in force.

## Notes

- Medical, wage and claim records stay in a firm-controlled tool. ASCR r 9 and Australian Privacy Principle 11 apply. A loss or unauthorised disclosure that is likely to result in serious harm may be notifiable under the Privacy Act 1988 (Cth).
- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts.
