| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the settlement or award and the repayment figure the lawyer accepts, set out the lump sum, any periodic compensation end date, and divide only if the lawyer has supplied the income-test limit. Do not add a superannuation disability payment into the lump sum. Do not write the advice. |
| What the lawyer must review | You decide whether the 50 per cent rule or an economic-loss amount applies to this lump sum. You supply the single-rate pension income-test limit for the settlement date. A disability payment from a superannuation fund is not compensation. Leave it out of the lump sum. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The lawyer classifies the Queensland lump sum and supplies the income-test limit. The tool does the arithmetic only with those inputs.

- What the AI does: From the settlement or award and the repayment figure the lawyer accepts, set out the lump sum, any periodic compensation end date, and divide only if the lawyer has supplied the income-test limit. Do not add a superannuation disability payment into the lump sum. Do not write the advice.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Start the period at the injury date, or the day after periodic compensation stopped, as the page states.
2. Add lump sums for the same injury only where one has an economic-loss component, as the lump-sum page states.
3. Exclude a superannuation disability payment.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- Services Australia says the number of weeks is 50 per cent of the lump sum divided by the single-rate pension income-test limit at the date of settlement. If the lump sum was awarded by a court or tribunal after a contested hearing, the calculation page uses the amount awarded for loss of earnings. The period usually starts on the date of injury, or the day after periodic compensation such as weekly workers' compensation stopped. Lump sums for the same injury are added only if one or more has a loss of earnings. The lump-sum page treats them as one sum if one has an economic-loss component. The income-test dollar limit is not printed on the calculation page.
- The lump-sum page lists rehabilitation, economic loss, non-economic loss, solicitors' costs, pain and suffering, impairment and medical expenses as components that may be in the sum. A global sum without an earnings split is still treated as in respect of lost earnings. The lawyers' page says a disability payment from a superannuation fund is not compensation for social security purposes. Workers' compensation and motor-vehicle third-party payments are examples of payments that must be told.

## Practical guide

Jurisdiction: Centrelink preclusion on a Queensland settlement

**Deliverable**: A week count only where the lawyer has supplied the limit and the compensation part.

**Inputs**

- The settlement or award
- The periodic compensation end date, if any
- The income-test limit the lawyer supplies

**Example**: Illustrative example: Weekly workers' compensation stopped on 1 May 2026 and a later lump sum was paid. The table starts the period on 2 May 2026. The week cell stays blank until the lawyer supplies the limit.

**Stop and escalate when**

- The income-test limit is not supplied.
- The sum is a superannuation disability payment only.
