## Checking plan

**Source-by-source verification**

Trace relied-on content to independent sources and check for relevant material the output has missed.

- What the AI does: From the bank statements and gift list the lawyer accepts, list financial assets, apply the published deeming thresholds, and list disposals above the free areas. The tool does not decide the rate of payment.
- What the lawyer does: The lawyer decides what is a financial asset, whether a disposal has adequate consideration, and how the income and assets tests apply.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Apply the deeming thresholds and rates stated on the Services Australia page, and confirm they are still current. When checked, the lower rate was 1.75 per cent and the upper rate 3.75 per cent, with thresholds of $66,800 for a single person, $110,600 combined where at least one of a couple gets a pension, and $55,300 each where neither gets a pension.
2. Include savings, term deposits, managed investments, listed shares and the other financial assets the page lists. Deeming does not apply to family tax benefit.
3. Count a disposal only above $10,000 in the financial year and $30,000 over five financial years, for disposals on or after 1 July 2002.
4. The lawyer decides adequate consideration. The tool does not.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
