## How this work usually runs

A social security matter usually starts with a letter: a debt notice, a cancellation or suspension, a rejected claim, or a Disability Support Pension refusal. The lawyer first gets the full decision and the payment and income history from Services Australia, works out what was decided and under which provision, and diarises the review ladder. The first step is an explanation or a formal review by an Authorised Review Officer, ideally within 13 weeks to protect arrears, with a request to pause debt recovery while it runs. For a debt the lawyer rebuilds the calculation fortnight by fortnight from payslips, bank records and the payment history, tests whether a debt exists at all and in what amount, and then whether it should be waived, including on special circumstances under s 1237AAD of the Social Security Act 1991, or written off. For a DSP refusal the lawyer maps the medical evidence against the 2023 Impairment Tables, testing whether each condition is diagnosed, reasonably treated and stabilised and whether the 20-point and Program of Support rules are met. If the ARO confirms the decision, the matter goes to the Administrative Review Tribunal for a first review, with no fee, then, if needed, a second review applied for within 28 days. A veterans' matter starts with a claim to DVA: the lawyer or advocate gathers service records, ADF and civilian medical records and the claim file, identifies which Act applies under the VETS Act transition, matches each condition to the applicable Statement of Principles and its factors, and later assesses permanent impairment on the MRCA scale of 0 to 100 points combined with a lifestyle rating of 0 to 7. A refused claim goes to the Veterans' Review Board, within 12 months for most decisions and 3 months for a VEA rate of pension, through its ADR program with mandatory outreach and then a hearing if needed, and from the Board to the Tribunal, a less veteran-friendly and more adversarial setting where DVA says veterans will need legal representation. Throughout, every submission and every piece of evidence filed in the Tribunal is subject to its Generative AI Practice Direction.

## Why this is its own area, and why AI is a live question in it

Centrelink debt, cancellation and Disability Support Pension disputes and veterans' claims are run every week by legal aid commissions, community legal centres, veterans' advocates and specialist firms, under their own statutes and their own review ladders. The AI question is sharper here than anywhere else in the library: the Royal Commission into the Robodebt Scheme found that an automated debt-raising scheme failed the people it served, and recommended a consistent legal framework for automation with a clear path to review (Recommendation 17.1) and a body to audit automated decision-making (17.2). Lawyers in this area challenge automated decisions, so their own tools must never produce a number the lawyer has not re-derived.

## Re-derive every number yourself

Debts, rates, Disability Support Pension impairment ratings and MRCA permanent impairment points are arithmetic on statutory rules. A tool that averages income across a period, adds points across Impairment Tables without applying the Program of Support rule, or combines impairment and lifestyle ratings wrongly will produce a confident figure that is wrong. Treat any tool output as a list of inputs to check, and recompute the figure from the source records before it is relied on.

## Work out which veterans' Act applies first

From 1 July 2026 the VETS Act closed the VEA and the DRCA to new compensation and rehabilitation claims, which are now decided under an improved MRCA, while claims lodged before that date stay under the Act they were made under and existing payments continue. DRCA decisions have gone to the Veterans' Review Board since 21 April 2025. Each condition has two Statements of Principles with different standards of proof. A template, prompt or research note that does not say which Act, which SoP and which version applies will mislead.

## Diarise the review ladder

For Centrelink, a formal review by an Authorised Review Officer should be sought within 13 weeks to keep full arrears; the Tribunal can only review after an ARO or SME decision; there is no time limit for most first reviews but back pay may be lost after 13 weeks, family assistance has 90 days and paid parental leave 28 days; a second review must be sought within 28 days of the first review decision. For veterans, a VRB review of an MRCA decision, a DRCA decision made after 21 April 2025 or a VEA entitlement decision is within 12 months, but a VEA entitlement review must be lodged within 3 months to keep maximum arrears and a VEA rate of pension or attendant allowance decision has only 3 months. Record each date the day the letter arrives.

## The client's account is evidence and stays theirs

Claim forms, statutory declarations and statements about income, relationships, service and symptoms are the client's own evidence. The Tribunal's Generative AI Practice Direction bars AI from making up, exaggerating, changing or adding to a person's evidence and requires disclosure where AI summarises information a witness relies on. A tool may organise the records; it does not write what the client says.
