## How this work usually runs

A residential tenancy matter usually starts with a notice. For a tenant, it is a termination notice, a notice to vacate or a notice to leave, a rent increase notice, a breach notice for arrears, or a bond claim by the landlord; for a landlord or agent, it is a tenant who has not left, has stopped paying rent, or has damaged the property. The lawyer first identifies which statute applies (the Residential Tenancies Act 2010 (NSW), the Residential Tenancies Act 1997 (Vic), the Residential Tenancies and Rooming Accommodation Act 2008 (Qld) or the Residential Tenancies Act 1987 (WA), and their equivalents elsewhere), the type of agreement and its dates, and then tests the notice: is the ground one the statute allows on that date, is the form the prescribed one, was the right notice period given for the method of service, were the required supporting documents or information statement attached, and was it served properly. In New South Wales and Victoria a landlord now needs a valid reason to end any tenancy; in Western Australia a no-grounds notice of 60 days for a periodic tenancy remains available. If the tenant does not leave, the landlord applies to the tribunal or court for a termination or possession order, and the tenant may contest the ground, seek more time or raise retaliation or discrimination. Arrears matters turn on the rent ledger: the lawyer reconciles what was due against what was paid before a breach notice is served or answered. At the end of the tenancy the bond is claimed through the State bond authority, and a disputed claim turns on the ingoing and outgoing condition reports, the photographs, and the invoices for repair and cleaning, measured against fair wear and tear. Running through all of it are the 2024 and 2025 reforms: limits on rent increases to once in 12 months, longer notice periods, re-letting exclusion periods after some grounds, and immediate termination rights for tenants affected by domestic or family violence.

## Why residential tenancies are their own area

Residential tenancy disputes are a high-volume part of civil practice, run by tenants' advocates, legal aid and community legal centres for renters and by property and litigation firms for landlords and agents. The library's leasing area is commercial and retail. Residential work has its own statutes, its own forms and its own tribunals, and it is template-heavy: notices, applications and bond claims are short, repetitive and form-driven, which makes them obvious candidates for AI drafting, while one wrong notice period or ground invalidates the notice.

## The law changed in 2025: check the date of every notice

New South Wales required a specific ground to end every lease type from 19 May 2025, and Victoria banned no-fault evictions from 25 November 2025, even at the end of a fixed term. Western Australia still allows a no-grounds notice. A tool or template built before those dates, or for a different State, will produce a notice that is invalid where it is served. Every template and prompt should name the jurisdiction and the date the law is stated at.

## Notice periods and grounds come from the statute, never from the tool

The notice period depends on the State, the type of agreement, its length, the ground and the method of service, and some grounds need supporting documents. Compute each period from the statute and the regulator's published table, and add the extra delivery time for posted notices where the law requires it. Treat any period or ground a tool suggests as unverified.

## Protect the tenant who is leaving because of violence

Where a tenant is ending a tenancy because of domestic or family violence, the evidence they give and the notice itself are confidential: in New South Wales the landlord must not give co-tenants a copy of the notice or the evidence. Do not put the address, the evidence or the other party's details into a tool without deciding first that it is safe, and keep the protection order work in A53.
