## Checking plan

**Lawyer leads the decision**

An evidence map for the practitioner’s right-to-deal review.

- What the AI does: Index permitted identity, title and authority records and show how they relate to the proposed transaction; flag inconsistent names or roles.
- What the lawyer does: The subscriber or authorised practitioner verifies identity, authority and the client’s right to deal under the applicable jurisdiction’s rules. AI does not perform that verification.
- Who reviews: The lawyer responsible for this task
- Basis: Suggested checking workflow informed by the linked official sources. The workflow and traffic light are framework guidance, not a source-issued AI classification.
- Why: A focused work product makes the review proportionate: check the source inputs and every material result, then resolve the specific exceptions before relying on it.
- Restriction: Pause if identity, authority or right to deal is uncertain. Escalate suspicious urgency, inconsistent documents or capacity concerns.
- Written for: AU

## Checks the lawyer makes

1. Identify the transacting party and the current registered interest from primary records.
2. Check the evidence linking that party to the property and resolve name changes, entities or other inconsistencies.
3. Read any power of attorney, trust instrument, grant or company authority relied on and confirm it permits this transaction.
4. Resolve suspicious instructions or capacity concerns through direct enquiries and retain the evidence supporting the practitioner’s conclusion.

## Notes

- ARNECC guidance does not replace the applicable Registrar’s rules. Version 8 material located in this research was a consultation draft and was not treated as operative law.

## Practical guide

Jurisdiction: Australian electronic conveyancing. Check the current Registrar’s Participation Rules in the relevant state or territory.

**Deliverable**: An evidence map for the practitioner’s right-to-deal review.

**Inputs**

- Current title
- The permitted identity-verification record
- Relevant authority documents and direct client instructions

**Example**: An attorney appears on the instructions but the power requires two attorneys to act jointly. Flag the authority issue before any signing step.

**Stop and escalate when**

- Pause if identity, authority or right to deal is uncertain.
- Escalate suspicious urgency, inconsistent documents or capacity concerns.
