## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Privacy, Data Protection & Cyber](https://ailawframework.com/practice/privacy-data-protection-and-cyber.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the item type and the dates the lawyer has already marked, calculate the last day the item stays on the report using only the periods on the OAIC table. Where the table says the later of two periods, calculate both and keep the later date. The tool does not choose the item type. |
| What the lawyer must review | The lawyer marks the item type before the calculation and checks each resulting date against the table. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to independent sources and check for relevant material the output has missed.

- What the AI does: From the item type and the dates the lawyer has already marked, calculate the last day the item stays on the report using only the periods on the OAIC table. Where the table says the later of two periods, calculate both and keep the later date. The tool does not choose the item type.
- What the lawyer does: The lawyer marks the item type before the calculation and checks each resulting date against the table.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Use only the periods on the OAIC table: 5 years for a court judgment, a credit enquiry and a default; 2 years for repayment history and for a current consumer credit obligation measured from the end of the credit; 1 year for financial hardship information; 7 years for a serious credit infringement.
2. For bankruptcy and for a debt agreement, calculate both limbs and keep the later date, using the debt-agreement events the table names.
3. Confirm the lawyer, not the tool, assigned the item type.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
