## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Planning & Environment](https://ailawframework.com/practice/planning-and-environment.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Record whether the comment file would be entered into a tool that discloses it, whether a person will verify every citation, and whether the comment might later be presented to a court. Write no comment and no objection. |
| What the lawyer must review | ABA Formal Opinion 512 requires verification of generative output. Model Rule 1.6 prohibits revealing information relating to the representation by entering it into a tool that discloses it, unless the client gives informed consent or an exception applies. Federal Rule of Civil Procedure 11 applies if the comment, or part of it, is later presented to a court by signing, filing, submitting, or advocating it. A comment sent only to a local agency is not, by itself, a paper presented to a court. You decide which of those settings this comment is in. The tool writes none of the comment. |

## Checking plan

- What the AI does: Record whether the comment file would be entered into a tool that discloses it, whether a person will verify every citation, and whether the comment might later be presented to a court. Write no comment and no objection.
- Basis: Checked against the linked sources on 22 October 2026. Confirm the current instrument before reliance.

## Notes

- No judge standing order on generative tools was opened. Do not add a disclosure paragraph.
- Local comment procedures come from the agency. They were not opened here.
