## Checking plan

**Verify against sources**

An accident in Victoria is covered regardless of registration. An accident outside Victoria is covered only in the cases the eligibility policy states.

- What the AI does: From the place of the accident, the registration, and whether the injured person is a Victorian resident or an occupant, table the eligibility rules and leave the scheme for the lawyer.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. An accident in Victoria is covered whether or not the vehicle is registered in Victoria. A non-resident injured in Victoria is covered.
2. An accident outside Victoria is covered if it involves a Victorian-registered vehicle and the injured person is a Victorian resident or an occupant of that vehicle. A non-resident is covered outside Victoria only as an occupant of a Victorian-registered vehicle.
3. The policy's example of a non-resident pedestrian, hit outside Victoria by a Victorian-registered vehicle, limits that person to the benefits of the place of the accident.
4. If the person can claim in another place, the Commission must deny or stop compensation or damages once that claim is accepted, compensation or damages are paid, an award is entered, the claim is settled, a payment into court is accepted, or an action for damages is commenced.

## Notes

- Travel insurance or personal-accident insurance does not stop the Commission accepting a claim. The deny-or-stop rule is the list above.
- The common-law policy assesses an overseas visitor's damages claim under the legislation of the place of the accident. When that place is Victoria, it uses the same rules as for a resident.

## Practical guide

Jurisdiction: Victoria. Eligibility after an accident in Victoria or outside Victoria.

**Deliverable**: An issues table of place, registration, residence and role, with the scheme left for the lawyer.

**Inputs**

- Place of the accident
- Registration and residence
- Whether the person was an occupant
- Any claim already made in another place

**Example**: Illustrative example: The accident was outside Victoria, the vehicle is Victorian-registered, and the injured person lives in Victoria. The table records those three facts and leaves the scheme blank for the lawyer.

**Stop and escalate when**

- The place or the registration is unknown.
- A claim in another place may have been started and its status is unknown.
