| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the accident place, the registration, where the person lives, and whether they were in the vehicle, table those facts against the rule for a driver or rider of a NSW registered vehicle injured outside NSW. Do not choose the scheme. |
| What the lawyer must review | Decide which scheme applies, and whether a second claim must stop. Apply the page only to a driver or rider of a NSW registered vehicle. Do not copy another place's benefits or time limits into this note. Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test. |

## Checking plan

**Verify against sources**

The lawyer decides the scheme. The tool tables the facts and the place-of-crash rule and does not choose.

- What the AI does: From the accident place, the registration, where the person lives, and whether they were in the vehicle, table those facts against the rule for a driver or rider of a NSW registered vehicle injured outside NSW. Do not choose the scheme.
- What the lawyer does: Decide which scheme applies and whether any second claim must stop.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. On the SIRA page, an interstate crash is a NSW registered motor vehicle involved in a crash in another Australian State or Territory.
2. If the person was injured while driving or riding that vehicle, eligibility for compulsory third party or motor accident scheme payments is determined by the laws of the place where the crash occurred. The page says its overview of other schemes may have changed.
3. The page does not use where the person lives, or whether they were in the vehicle, as the test. A passenger, or a person outside the vehicle, is not decided by the driving-or-riding sentence. Those facts stay on the table for the lawyer.
4. Clause 4.39 is a different fact. Where a vehicle considered at fault was registered outside NSW, the NSW insurer paying statutory benefits for the Nominal Defendant must copy the liability notice to that vehicle's insurer, at the initial decision and at each later decision under section 6.19, including the notice for benefits after 52 weeks. That clause does not choose the scheme. Section 6.19 was not opened.

## Notes

- The page sorts other places into groups and then sets out benefits and claim times for each place. Those details are not copied into this version. The lawyer checks the current law of the crash place. Do not treat the page as a decision about which scheme applies.

## Practical guide

Jurisdiction: SIRA guidance on a crash outside NSW involving a NSW registered vehicle, and Motor Accident Guidelines clause 4.39

**Deliverable**: A fact table and the place-of-crash rule. No scheme is chosen.

**Inputs**

- Accident place
- Each vehicle's registration
- Where the injured person lives
- Whether the person was driving, riding, a passenger, or outside the vehicle

**Example**: Illustrative example: The injured person was driving a NSW registered car when it crashed outside NSW. The tool records the crash place and the registration and does not name a scheme or copy a benefit.

**Stop and escalate when**

- The tool is asked to choose the scheme or to copy another place's benefits or time limits.
- The person was not driving or riding, and the tool is asked to apply the driving-or-riding sentence.
