## Checking plan

**Verify against sources**

The lawyer applies section 144A to the payment history. The WorkSafe page is not a substitute for the section.

- What the AI does: List the section 144A stop points against the payment history the lawyer provides, and flag any earlier stop the file suggests.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 144A(1): weekly payments under part 9 stop when the first of these happens: the incapacity because of the work-related injury stops; the worker has received weekly payments for the incapacity for five years; or compensation under that part reaches the maximum amount under part 6.
2. Section 144A(2) and (3): if the five years or the maximum is reached, entitlement to further compensation for the injury stops, except compensation under chapter 4A.
3. Section 144A(4): the section does not limit another provision that stops weekly payments. The lawyer finds that provision in the Act before advising.
4. The WorkSafe weekly-payments page also lists a return to work and earning income, and a lump sum offer. Those words are not section 144A(1). The same page says the first week is paid by the employer as the excess. Do not state a percentage or a dollar maximum.

## Notes

- The tool does not decide that payments have stopped. It lines the history up against the section.
- The advice may go to the client. Guidance Statement No. 37 applies. Wage and medical information stays in a firm-controlled tool.

## Practical guide

Jurisdiction: Queensland weekly payments of workers' compensation under chapter 3, part 9.

**Deliverable**: A comparison of the payment history with the section 144A stop points, for the lawyer's advice.

**Inputs**

- Payment history the lawyer provides
- What is known about ongoing incapacity
- Whether chapter 4A compensation is in issue

**Example**: Illustrative example: The worker has returned to work on suitable duties and is still incapacitated for the pre-injury role. The draft does not treat the return as the end of incapacity. The lawyer decides whether section 144A(1)(a) has happened.

**Stop and escalate when**

- The history is incomplete.
- The output states a dollar maximum or a percentage of weekly pay.
