## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the payslips, the work capacity certificate and the payment history, set out normal weekly earnings, what the certificate says about time off work, how long weekly payments have been made, and which of the four stop events has happened. Include the wage items the normal-weekly-earnings page includes, and exclude the items it excludes. Do not apply a percentage the pages do not state, and do not state the QOTE dollar rate. |
| What the lawyer must review | The lawyer decides the weekly amount. The pages do not state a step-down percentage. The first week is the employer's excess, not an insurer payment. Payments stop at the first of the four events on the weekly page. A dispute about the calculation is a review, not a new arithmetic exercise. |

## Checking plan

**Verify against sources**

The tool lays out normal weekly earnings and time on payments. It does not invent a rate.

- What the AI does: From the payslips, the work capacity certificate and the payment history, set out normal weekly earnings, what the certificate says about time off work, how long weekly payments have been made, and which of the four stop events has happened. Include the wage items the normal-weekly-earnings page includes, and exclude the items it excludes. Do not apply a percentage the pages do not state, and do not state the QOTE dollar rate.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Build normal weekly earnings from 12 months of wages with the current employer, or the shorter period if employment was shorter.
2. Include salary, regular overtime, higher duties, penalty rates and allowances that are not in the excluded list.
3. Exclude travel and similar allowances, superannuation, termination lump sums, and amounts paid as employer excess.
4. Record whether payments have already run for five years, a lump sum has been offered, or the worker has returned to work and is earning.

## Notes

- Health, wage and benefit records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- If 12 months of earnings are unavailable, the page allows earnings over the actual employment, or another worker's earnings under the same industrial instrument. QOTE is published in the Workers' Compensation and Rehabilitation (QOTE) Notice.
- A worker who disputes the calculation can ask the insurer for written reasons and seek a review. A decision to increase or decrease a weekly payment is a reviewable example. A decision on ongoing management is not.

## Practical guide

Jurisdiction: WorkCover Queensland or a self-insurer, weekly compensation

**Deliverable**: A weekly-payments worksheet of earnings, capacity and stop events, with no percentage applied.

**Inputs**

- Payslips or a 12-month payroll report
- Work capacity certificate
- Insurer payment history
- Current QOTE notice if the lawyer asks for that comparison

**Example**: Illustrative example: Payslips cover eight months. The sheet totals those earnings and records that the page allows a shorter history. It does not convert the total into a compensation rate.

**Stop and escalate when**

- A percentage or a maximum weekly dollar figure would have to be taken from memory.
- The worker has returned to work and the earnings in that work are not on the file.
