## Checks the lawyer makes

1. Separate a work injury, a motor accident, a public or occupier's incident, and a dust-related condition.
2. For work, note the 6-month application period in s 131 and the documents for normal weekly earnings.
3. For a motor accident, note s 37 and, if the injury may be serious, the NIISQ injury types.
4. For any other personal injury, check PIPA s 6 before naming a PIPA notice.

## Notes

- Health, wage and benefit records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- NIISQ injury types on the agency page are permanent spinal cord injury, traumatic brain injury, severe burns, multiple or high-level limb amputation, and permanent blindness caused by trauma. Detailed criteria are on that page.

## Practical guide

**Example**: Illustrative example: The enquirer was hurt driving between a depot and a site. The list records both a possible work application and a possible motor accident notice, and leaves the scheme undecided.

**Stop and escalate when**

- The output would be sent to the enquirer as a conclusion that they have a claim.
- The facts are too thin to name even a possible path.
