| How AI is used | From the account and the employer documents the lawyer selects, using a firm-controlled tool, table each event against the elements in section 32. Do not decide whether the injury is compensable. |
| What the lawyer must review | You decide compensability, including whether section 32(5) applies. Stop if the facts are a journey or a recess. Sections 34 and 35 were not opened. Do not apply another place's management-action test. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The lawyer applies section 32. The tool tables the events against the elements the section states.

- What the AI does: From the account and the employer documents the lawyer selects, using a firm-controlled tool, table each event against the elements in section 32. Do not decide whether the injury is compensable.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Record whether employment is put as a significant contributing factor.
2. Table reasonable management action, the worker's expectation or perception, and Regulator or insurer action separately.
3. Do not mark the injury compensable or not.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- Section 32(1) defines injury as personal injury arising out of or in the course of employment if employment is a significant contributing factor. Section 32(5) says injury does not include a psychiatric or psychological disorder arising out of or in the course of reasonable management action taken in a reasonable way in connection with the employment, the worker's expectation or perception of reasonable management action taken against the worker, or action by the Regulator or an insurer about the compensation application. The examples are transfer, demotion, discipline, redeployment, retrenchment or dismissal, and a decision not to award promotion, reclassification, transfer, leave or a benefit connected with the employment.
- Section 32(2) says employment need not be a contributing factor if section 34(2) or section 35(2) applies. Those sections were not opened. The claim page does not restate section 32(5). AustLII can lag the Queensland legislation site.

## Practical guide

Jurisdiction: Psychological injury under the Workers' Compensation and Rehabilitation Act 2003

**Deliverable**: An event table against section 32. No compensability conclusion.

**Inputs**

- The account the lawyer selects
- The employer documents
- Whether the event is said to be on a journey or during a recess

**Example**: Illustrative example: The account says the symptoms followed a performance meeting. The table places that meeting under section 32(5)(a) and leaves reasonable and reasonable way blank for the lawyer.

**Stop and escalate when**

- The events are not in the selected documents.
- The injury is said to arise on a journey or during a recess.
