## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the cancer, the service, the organisation and the diagnosis date, using a firm-controlled tool, table the 12 cancers and the limits the SIRA pages state. Do not decide the presumption. |
| What the lawyer must review | Decide whether section 19A and Schedule 4 are open, not only the page's list of 12. Schedule 4 Part 2 includes cervical, ovarian, lung and skin. Do not treat them as another scheme's list. Leave the pre-27 September 2018 circumstances for the original 12 open. The page does not list them. Health and wage records stay in a firm-controlled tool. Apply ASCR r 9, APP 11, and the notifiable-breach test. |

## Checking plan

**Verify against sources**

Twelve primary cancers are listed for a diagnosis on or after 27 September 2018, with oesophageal cancer at 25 years. There is no post-service time limit on the page. The named organisations are Fire and Rescue NSW, the NSW Rural Fire Service, the Office of Environment and Heritage for the National Parks and Wildlife Service, Forestry Corporation of NSW, and Sydney Trains. A Fire and Rescue Community Fire Unit volunteer is excluded on the disease page. The employer may prove the cancer is not related to the firefighting. The presumption does not create new benefits.

- What the AI does: From the cancer, the service, the organisation and the diagnosis date, using a firm-controlled tool, table the 12 cancers and the limits the SIRA pages state. Do not decide the presumption.
- What the lawyer does: The lawyer decides the legal question, checks the sources, and authorises anything the family or the insurer will receive.
- Who reviews: Lawyer competent in statutory workers compensation
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Match the cancer to Schedule 4 of the Workers Compensation Act 1987, not only to the SIRA page's list of 12. Part 1 is that list of 12. Part 2 adds primary site pancreatic, thyroid, cervical, ovarian, uterine, vaginal, vulval, penile, lung and skin cancers. Liver cancer is not in the Schedule read.
2. Check the organisation and the Community Fire Unit exclusion.
3. Use 27 September 2018 only for the page's account of the original 12. Do not invent the earlier retrospective circumstances. Do not apply that date to a Part 2 cancer until the commencement of the 2025 Schedule 4 amendment is opened.
4. Keep the ordinary disease test separate if the presumption is not open.

## Notes

- If this is lodged with the Personal Injury Commission, Procedural Direction PIC13 keeps health records in a controlled environment and forbids a generative tool from writing a person's evidence.
- Both SIRA pages were current when opened. The firefighter page was updated 19 December 2024. Confirm the Act, including section 19A, which the disease page cites.
- If health or wage records leave the firm-controlled tool, decide whether a Privacy Act 1988 (Cth) breach is notifiable.

## Practical guide

Jurisdiction: New South Wales, firefighter cancer presumption, SIRA pages

**Deliverable**: A presumption table against the 12 cancers, the organisation and the diagnosis date.

**Inputs**

- Diagnosis
- Employer or volunteer service and dates
- Diagnosis date

**Example**: Illustrative example: A former rural firefighter is diagnosed with a listed cancer three years after retiring, with the qualifying service met. The note records that the page states no post-service deadline. It does not say the claim succeeds. The lawyer decides, including any rebuttal the employer has raised.

**Stop and escalate when**

- The person volunteered only in a Community Fire Unit.
- The diagnosis is before 27 September 2018 and the page's missing circumstances would have to be invented.

Checked 2026-10-23.
